American Aeroplane Programme

In the field of general aviation, many aeroplane owners are finding that one of the most popular jurisdictions for aeroplane registration is that of the United States of America for reasons related to maintenance schedules and the advantages applicable to FAA pilot licences, ratings and even
medical certificates, the more so since the British CAA has tightened up on the rules for maintenance of validity of licences.

Such restrictions do not apply to FAA pilot certificates. It is generally recognised that the USA has been a great pioneer in flying over the years.

The function of our N registered aeroplane programme is solely to provide a system of registration of aircraft which are then used by persons not entitled to legal ownership of an aircraft on the N register and that alone. We do this by arranging documentation with a corporate trustee which is
registered, located and managed in the United States.

It is no longer an expensive or complicated business to maintain an aeroplane on the US register for non-US citizens and with FAA maintenance and training facilities becoming more readily available in Europe, the idea is very attractive. We offer the facility of N registration together in association with our parent firm of chartered accountants which brings the costs right down but in addition provides complete protection to its clients.

Under part 47 of the Federal Aviation Regulations, an American registered aeroplane must be owned by a US citizen. This can include a corporation subject to certain conditions which our scheme meets. The documentation for our scheme is prepared in Europe and in addition we can provide a range of professional services which may be of assistance in any particular case.

The registration is effected by entering into one trust agreement and, provided the specified charges are paid, the aeroplane will be held in trust for the beneficial owner and he will have full use of it subject only to legal requirements which might be imposed by the US government. Our agreement is written in English and governed by the laws of England and Wales but is open to persons of any nationality or domicile, unless precluded by law, e.g. where sanctions exist.

A word of explanation is probably required to explain why the US government has imposed the restriction of allowing only US citizens to register an aircraft. The government may wish to
procure the use of an aircraft, for example in a time of war or equally may wish to prevent an aircraft from being involved in a situation, such as the assistance of an enemy. By having
US citizens in the front line of responsibility, the government can procure its requirements by imposing those requirements on its own citizens, something which, outside its jurisdiction it could not procure as against the citizens of other nations.

Accordingly, the US citizens who act as trustees in these matters are undertaking a considerable potential responsibility on behalf of aeroplane users. No doubt, there are few occasions when aircraft are used other than in accordance with authorised uses but nonetheless that responsibility must be recognised. In practice we have not known of any such restrictions or prohibitions which have affected any of our clients but our agreements do provide that the effective requirements of US law, and consequential events, do override other considerations if activated.

Our basic facility is straightforward and inexpensive; in certain circumstances a more complex facility may be required and the standard charges would not apply in those circumstances.

The charges are as follows:

  • To register an aeroplane including first year – € 570
  • Annual renewal – € 450
  • To cancel registration – € 130

Note: the registration fee includes the first year FAA charges.
There is a registration fee for a radio licence, currently $115, which is extra.

We will also obtain the airplane radio licence for you if required and all ADs are forwarded immediately on receipt. Certain additional services may be required, such as an expedited certificate of registration for an aircraft which is overseas. Additional costs will apply to such services.

It is important for us to make it clear that the trust service is simply that; we keep it straightforward to save costs. We would be pleased to advise on peripheral issues but such advice will involve a charge based on our normal rates.Such peripheral issues often include matters like liability to VAT, the position as regards taxation of benefits in kind relating to aeroplanes, transferring aircraft from other registers to the US register, maintenance issues, pilot
licensing issues etc.

Any additional work or disbursements in relation to licences or advice required will be charged at on a time spent basis in accordance with our standard terms and conditions of business which are available on request but there are no hidden extras and no additional charges will be levied without prior notification.

It must be emphasised that proper legal documentation is provided in relation to ownership for your protection and the security of knowing that you are dealing with professionally qualified people on both sides of “the pond”. We are pleased to be able to confirm that the documentation used has passed inspection by the FAA. The formalities are fulfilled following completion of a straightforward application form which is available on request and which includes a copy of the terms
and conditions.
